Disinfo: Ukrainian President Petro Poroshenko has declared war on Russia

Summary

Ukrainian President Petro Poroshenko has declared war on Russia.

Disproof

Ukrainian President Petro Poroshenko in an interview with Fox News addressed Russian President Vladimir Putin and called an act of "war" the attack of the Russian military on Ukrainian sailors in the Kerch Strait. "Mr. Putin, this is the act of aggression. Mr. Putin, this is the war. And this is not a joke, and not an incident, and not a crisis," Poroshenko said, See the interview on Poroshenko's Facebook page.It was Russia that provoked the war in Ukraine. The Office of the Prosecutor of the International Criminal Court has stated that “the information available suggests that the situation within the territory of Crimea and Sevastopol amounts to an international armed conflict between Ukraine and the Russian Federation. This international armed conflict began at the latest on 26 February when the Russian Federation deployed members of its armed forces to gain control over parts of the Ukrainian territory without the consent of the Ukrainian Government https://www.icc-cpi.int/iccdocs/otp/161114-otp-rep-PE_ENG.pdf.See recurring pro-Kremlin disinformation messages around the Azov Sea.

Disinfo: The US is paying for Ukrainian security forces and Ukrainian provocations

Ukraine’s provocative actions, aimed at confrontation with Russia, are fuelled by foreign curators, who also pay for these actions. Recently, the US had to earmark more funds to Ukrainian security forces and provide an oversight over them. The proof for that is a list of military tenders by the US State Department, which includes equipment and services for Ukraine.

Disproof

The tender list is publicly available on the US Embassy in Ukraine web site. The equipment and services are devoted to Ukraine in the framework of aid and partnership programmes. The false narrative about Ukraine provoking Russia is a recurring one, so is the message about Ukraine colluding with the West. For further debunking, see StopFake.org.

Disinfo: By terminating the Friendship Treaty with Russia, Ukraine lost its rights of passage through Kerch Strait

Ukraine’s decision to terminate the Treaty on Friendship, Cooperation and Partnership between Ukraine and the Russian Federation results in the fact that the legal basis for the Treaty of the Sea of Azov and the Kerch Strait is no longer valid. Therefore, Kiev deprives itself of the right of free navigation in the Azov-Kerch region.

Disproof

According to the UN Convention on the Law of the Sea (UNCLOS), all ships, including foreign warships, enjoy the right of "innocent passage" within another state's territorial sea under international law. The Agreement between the Russian Federation and the Ukraine on cooperation in the use of the sea of Azov and the strait of Kerch (2003) simply refers to the Treaty on friendship, cooperation and partnership between Ukraine and the Russian Federation. All possible requirements for termination of a treaty are listed in the Vienna Convention on the Law of Treaties. These requirements have not been fulfilled, so the treaty regulating the passage through Kerch Strait should still be in force. Recurring pro-Kremlin narrative on Azov sea.
